Personally

Terms of Service

Effective January 1, 2025

These terms apply to the Personally website and service, provided by Momentous Growth LLC (“Personally,” “we,” “us”). They cover organizations that use Personally and people who receive messages sent through it. By using Personally or receiving its messages, you agree to these terms.

What Personally does

Personally lets a nonprofit thank its donors. The organization’s leader records a short sample, and with their written consent we create a model of their voice. The organization writes one thank-you message. When a gift arrives, the donor hears that message in the leader’s voice, with their first name in it, as a voicemail or on a web page linked from an email.

Messaging terms for donors

What you’ll receive

If you gave to an organization that uses Personally, you may receive a thank-you for your gift. You receive a voicemail only if you gave a mobile number and agreed on the donation form to receive one. Otherwise you may receive an email with a link to listen. These messages say thank you. They don’t ask for money or anything else.

How often

One thank-you per gift, and no more than one thank-you from the same organization in any 30-day period.

Costs

We don’t charge you for messages. Message and data rates may apply from your mobile carrier.

How to stop messages

You can stop at any time. Call the number given in the voicemail, use the opt-out link in any email or on the listen page, or email us. One opt-out stops both voicemails and emails from that organization.

How to get help

Email jeff@momentousgrowth.com or contact the organization that thanked you.

Carriers

Mobile carriers are not liable for delayed or undelivered messages.

Privacy

We do not share mobile phone numbers or messaging consent with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

The AI voice

Personally messages are spoken in a voice recreated with AI from the leader’s own recording, with that person’s written permission. Every listen page says so. Organizations may not remove or obscure this disclosure, and may not present the message as a live call.

Terms for organizations

If you use Personally for your organization, you agree to the following.

  • Donor consent. Before we leave a voicemail for anyone on your behalf, you must have that person’s consent as the law requires. At a minimum, your donation form must carry the voicemail consent wording we provide or wording your counsel approves: an unchecked box, an optional phone field, your organization’s name, notice of a recorded and AI-generated voice, a statement that agreeing is not required to give, and a way to opt out. You must send us accurate consent information with each gift.
  • Legal sign-off on voicemail. Voicemail stays off until you confirm in writing that your legal counsel has reviewed your use of it. You are responsible for that review and for following the laws that apply to you.
  • The voice owner. You may use a person’s voice only with that person’s written permission. You must tell us promptly if that permission ends or the person leaves your organization.
  • Content. You are responsible for the messages you write and approve. Messages must be lawful and truthful, and must not ask for money, promote products or events, or solicit anything.
  • Opt-outs. You must honor opt-out requests you receive and tell us about them promptly. We honor the ones we receive.
  • Accurate data. You are responsible for the accuracy of the gift and contact information you send us, and for having the right to share it with us.
  • Responsibility for claims. You agree to cover our reasonable costs of claims that arise from your breach of these terms, including messages sent to someone you said had consented.

Billing

You agree to pay the fees for the plan you choose. Fees are billed in advance through Stripe and are not refundable, except where the law requires. Messages stop sending if your account is unpaid. You may cancel at any time, and your plan runs to the end of the period you paid for.

Suspension and ending service

We may pause or suspend sending, or close an account, to protect recipients, to comply with the law or carrier rules, if these terms are broken, or for unpaid fees. When possible, we will tell you first. When an account closes, we delete data as described in our Privacy Policy.

Disclaimer

Personally is provided “as is” and “as available,” without warranties of any kind, to the extent the law allows. We don’t guarantee that every message will be delivered, delivered at a particular time, or pronounced perfectly, because delivery depends on phone carriers, email providers and recipients’ devices. We don’t promise any effect on giving or donor retention.

Limit of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or donations. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

Governing law

These terms are governed by the laws of the State of Texas.

Changes

We may update these terms. We will post the new version here with a new effective date. If a change is significant, we will also tell our customers by email.
